For years, it’s always been debated whether to legalise natural drugs such as cannabis and magic mushrooms in Canada. Recent studies have highlighted the significance of these psilocybin shrooms as medically useful against many illnesses, and people now more than ever are in search of natural alternatives. 

Are Shrooms Legal in Canada?

Nevertheless, the subject of the legal status of magic mushrooms is still a big question mark, especially with a lot of confusion stemming from the growing number of online dispensaries available. 

In Canada, magic mushrooms remain a banned substance. This article looks at the legality of shrooms, and what the future looks like for the magic fungi. 

What Is The Legal Status of Shrooms in Canada?

Under the Controlled Drugs and Substances Act (CDSA),  the act of buying, selling, growing and consuming psilocybin mushrooms is illegal in Canada. Those caught in possession of magic mushrooms can face up to 6 months in jail or a $1000 fine, and in some cases both penalties can be applied.[1] 

Under section 56, exceptions can be made if psilocybin is required for medical studies and trials.This can take a lot of paperwork and can easily be denied, making it hard for those who legally want to consume shrooms.

The drug not only has to fight in the courts; extensive experimental results will be required to the Ministry of Health in Canada to accept the legitimacy of psilobin’s positive effects . 

Shrooms have become popular in North America and many parts of Europe, with many european countries legalising the fungi. The US Food and Drug Administration claims that strong medical grounds of this drug should be acknowledged by the FDA and drug development process[2]. Therefore, there’s still hope that it could be approved for medical purposes. 

The psilocybin chemical found in magic mushrooms needs proper authorization for sale, purchase, and manufacturing of this drug. It is only authorized by the state for research purposes or clinical trials under Part J of the Food and Drug regulation, which means those consuming from a dealer or online dispensary are doing so at a potential risk. 

Will Magic Mushrooms Be Legal in The Future?

What’s surprising is that although it is illegal to purchase dried or fresh magic mushrooms in Canada, you can buy growing kits and spores through online dispensaries, and even have the goods delivered straight to your doorstep.

Interestingly, once your mycelium starts to sprout, the legal status of the commodity changes, drastically. It now becomes illegal, and care should be taken that you don’t end up with criminal charges. 

With the changes in the legal status of Cannabis in Canada, it is not unlikely that the psilocybin will become legal in the future. Psilocybin dispensaries online are widely common now and make purchasing shrooms available to all regions of Canada. 

Larsen, an influencer, is working and providing the drug in minute quantities (known as microdosing) to Canadians. The motive is to provide curing medication to people, rather than sending them on a magic mushroom high. The research he has conducted has provided plenty of evidence to Health Canada that people do not feel physical withdrawal or psychological dependence symptoms after consuming magic mushroom. This is a positive sign for the future of legal magic mushrooms in Canada. [3] 

In addition, various political and legal movements broke out in Canada. They stood up against the prevention of the sale of magic mushrooms, but the government denied all the petitions. 

One such motion was seen in September 2019 at the Vancouver city council. Many speakers presented points in favor of psilocybin shrooms. They used the argument that drug prohibition and criminal enforcement, regarding drug cases, are a huge burden on the financial resources of the country. This was mentioned in addition to the benefits of taking psilocybin for conditions such as depression and anxiety.   

The Benefits and Risks of Making Magic Mushrooms Legal

It is impossible to ignore the fact that everything has its perks and disadvantages. The same is the case with magic mushrooms. According to various studies, it’s evident that shrooms containing psilocybin are great for treating issues like anxiety and depression. The effects of taking shrooms include:

  • Open-mindedness
  • Feelings of happiness and euphoria
  • Positive emotions
  • A loss of ego and a willingness to connect with your environment 

Magic mushrooms affect the “functional connectivity” of the brain, stimulating many hormones and uplifting the emotional responsiveness region of the brain. [4]

However, there are various side effects, both mental and physical, that are a cause for worry for lawmakers. Some of these include:

  • Mood swings
  • Paranoia and panic
  • Increased heart rate and blood pressure 
  • Vomiting and nausea
  • Chills and sometimes scary hallucinations

Another risk associated with magic mushrooms is that the studies have failed to evaluate the long-term effects of them. However, there is also a lack of evidence that magic mushrooms cause any sort of physical or psychological dependence. But, like all other psychedelics, frequent use may make you tolerant of a certain level of dosage. [3]

At the moment, there are no approved therapeutic products or medicines that contain psilocybin in Canada.  If made legal, the Canadian authorities could educate people regarding the use, dosage, intake, and medical implications of these shrooms (like we’ve seen in regards to cannabis). This will help people to understand the optimal quantity that should be taken to achieve positive effects.

 In addition, the government can also regulate the source of these drugs for the betterment of society and individuals as a whole. 


The above information indicates that the future of psilocybin drugs in Canada is very bright and promising. There are numerous dispensaries operating now in Canada, although they are still technically breaking the law. Health Canada is now also beginning to acknowledge the medical benefits of shrooms, however there’s still a while to go before anything concrete and law changing takes place.
